Expert lawyers on enforcement of European judgements in Spain.

The Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and, states rules governing the recognition and enforcement of European judgments in civil and commercial matters.

A judgment given in an European Union country is to be recognised following the proceedings laid down by the Regulation Brussels I.

Member States’ courts are obliged to obey the Regulation and they cannot contest the Regulation when the reasons underlying the objection are internal laws not complying with the European Union freedoms.

The Regulation does not cover:

a) revenue, customs or administrative matters;

b) the status or legal capacity of natural persons, matrimonial matters, wills and succession;

c) bankruptcy;

d) social security;

e) arbitration.
